Q: How long does it usually take to find a tenant?  一般多少时间可以找到租客?

A: Unlike a sublease agreement, the landlord does not actually have the right to screen subtenants, as the original tenant remains responsible for rent and any matters occurring within the leased premises. In a sublease scenario, the landlord does not deal directly with the sublessee but only with your tenant 与转让协议不同,房东并没有真正的权利来筛选转租对象,因为原来的租客仍然要对租金和出租屋内发生的任何事情负责。在转租的情况下,房东不会直接与转租人打交道,而只需要与您的租客打交道。

 

Q: What happens if a tenant sublets the property without notifying the landlord in advance? 如果租客没有事先通知房东他将要转租,会发生什么?

 

A: If a tenant sublets the rental property without the landlord’s consent, the landlord may apply to the Tenancy Tribunal to evict the “unauthorized” tenant. The landlord must file the application with the Tenancy Tribunal within 60 days of discovering the unauthorized tenant. 如果租客未经房东的同意而私自转让出租屋,房东可向租务法庭申请驱逐该“未经授权”的租客。房东必须在发现未获授权的租客后60天内向租务法庭提出申请。

 

Q: What happens if the landlord refuses to allow subletting? 如果房东拒绝转租会发生什么?

 

A: If a tenant requests the landlord’s consent to sublet the rental property, the tenant may send a termination notice to the landlord within 30 days after submitting the sublet request.  如果租客要求房东同意转让出租屋,租客可以在提出转让要求后的30天内,向房东发送终止协议通知。

All landlords should know 所有房东都应该知道:

It is not permissible to arbitrarily or unreasonably refuse to transfer the leased property to potential sub-tenants. 不得任意或不合理地拒绝将出出租屋转让给潜在的二转租客;

If the landlord has generally agreed to the transfer deed, they may refuse to sublet a specific secondary tenant. 房东如已大致同意转让契,可拒绝转租某一指定的二转租客;

The landlord may only charge the tenant reasonable out-of-pocket expenses incurred due to their agreement.房东只可向租客收取因同意而产生的合理的自付费用。

 

Q: What form do I need to fill out if one of the two tenants has moved out of the rental house and the other new tenant wants to move in? 如果两名合租人中有一人搬迁出了出租屋,而另一名新的合租人要搬入,需要填写什么表格?

 

A: There are no special application forms available for use. Ensure that the co tenant who is about to move out gives you a letter confirming that he/she will be relocating. Regarding the new co tenant, you can add an appendix to the lease agreement stating when the new tenant will move into the rental property and assume the share of the upcoming tenant in the lease. 没有任何特殊的申请表可以使用。确保即将搬离的合租人给您一封确认他/她将要搬迁的信。关于新的合租人,您可以在租约中加入一份附录,说明新租客将会在何时搬进出租屋,并承担即将离开的那一名租客在租约中的份额。

 

Q: What does subletting mean? 转租到底是什么意思?

 

A: When a tenant “transfers” the rented property, the tenant waives all rights and responsibilities related to the leased unit and lease agreement, and transfers it to a new tenant. 当租客“转让”出租屋时,租客放弃了与租赁单元和租赁协议相关的所有权利和责任,并将其转让给新的租客。

 

Q: If a tenant requests to ‘transfer’ the rented property, does the landlord have any choice? 如果租客要求“转让”出租屋,作为房东有任何选择权吗?

 

A: The Rent Law stipulates several provisions regarding the issue of “transfer”. There are two types of transfer consent forms: “general consent” or “explicit consent”.《租务法》规定了有关“转让”问题的若干条款。转让同意书有两种类型:“一般同意”或“明确同意”。

Landlord shall not unreasonably or arbitrarily refuse to agree to transfer the rental property to potential secondary tenants  房东不得无理由或自行武断地拒绝同意将出租屋转让给潜在的二转租客

 

Q: The tenant of my basement hopes to move out of the rental house by the end of March, but his lease agreement is until the end of July. For this reason, he hopes to transfer the rental property, but I will be on vacation abroad until May before returning. Can I refuse his sublease request because I am not present? 我家地下室的租客希望能在三月底搬离出租屋,但是他的租赁合同是到7月底。为此他希望能够转让出租屋,但是我将出国度假直到5月才回来。由于我不在场我能因此拒绝他的转租要求吗?

 

A: If the tenant requests your consent to transfer the lease, you do have the right to refuse consent. However, if you refuse, the tenant has the right to give 30 days’ notice and terminate the lease. 如果租客要求您同意转让租约,您确实有权拒绝同意。但是,如果您拒绝,租客有权提前30天通知并终止租约。

 

Q: My tenant moved out of the rental house without notifying me, taking away his furniture and all personal belongings, but leaving a stranger in the rental house who claimed to be a second tenant. A: If your tenant has moved out of the rental property and left others inside without your prior consent to transfer or sublet the rental property, this situation is considered an unauthorized tenant. If this is the case, you must submit an application to the leasing court to evict unauthorized residents. The application you need to submit is A2 (i.e. sublease or transfer application form). This application must be submitted within 60 days of discovering unauthorized residents. The rental court will arrange a hearing and issue a decision to evict residents living in the rental property. 如果您的租客已搬离出租屋,而把其他人留在出租屋内,并没有事先得到您的同意就转让或分租了该出租屋,这种情况则被视为未获授权的租客。如果是这种情况,您必须向租务法庭提交申请,驱逐未获授权的居住者。您需要提交的申请是A2(即转租或转让的申请表)。此申请必须在发现未获授权的居住者后60天内提出。租务法庭会安排一场听证会,并发布驱逐住在出租屋内居住者的决定。

 

Q: I don’t have a lease agreement with the tenant, but the tenant is asking me to agree to sublet. Is this legal? 我跟租客之间没有租赁合同,但是租客要求我同意转租,这是合法的吗?

 

A: The provisions on subletting rental properties in the Rent Law apply to all leases, regardless of whether they have a fixed lease term, with the consent of the landlord. In the case of sublease, the sublease agreement must end on a specific date before or during the tenant’s lease term.《租务法》中有关出租屋转租的规定,在房东同意的情况下,适用于所有租约,不论是否有固定租期。在转租情况下,转租协议必须在租客的租期或租期结束前的特定日期结束。

 

Q: How should I negotiate with my tenant? During the months when her rental property was vacant, she let others live in the rental property? 我该怎么跟我的租客交涉,在她空置出租屋的几个月期间,她让其他人住在了出租屋内?

 

A: This seems to be a case of subletting, but if tenants plan to sublet their rented property, they must obtain the landlord’s consent and there must also be a subletting agreement between them. A: If a tenant sublets their rental property without your consent, you can take some measures, such as applying to the leasing court to terminate the lease and evict unauthorized occupants. However, you are somewhat powerless when it comes to minors. The Rent Law does not have any age regulations, but in fact, according to the Human Rights Law, landlords cannot refuse to provide housing because a person is under age.如果租客在未经您同意的情况下转租了他的出租屋,您可以采取一些措施,比如向租务法庭申请终止租赁并驱逐未获授权的居住者。然而,对于未成年人您就有些无能为力了。《租务法》没有任何关于年龄的规定,但事实上,根据《人权法》,房东不能因为人的年龄不足而拒绝提供住房。
